Agreement to Terms

By accessing or using ProofAge services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Description of Services

ProofAge provides identity verification services through a RESTful API and web-based interface. We offer two verification flows:

Age Verification

Confirms that a person meets a required age threshold. Two verification modes are available:

• Age Estimation — a selfie-only check that uses AI-based face analysis to estimate age. No identity documents are required.
• ID Age Verification — age is confirmed using an identity document combined with a liveness selfie. This mode supports configurable age thresholds and provides higher accuracy.

KYC Verification

Know Your Customer (KYC) identity verification using identity documents and a liveness selfie. Extracts and validates personal data from the document.

All flows include webhook notifications, API access, and white-label customization options.

Account Registration

To use our services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Represent a legitimate business entity (for API access)
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

Acceptable Use Policy

You agree not to use ProofAge services to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or conduct security attacks
• Attempt to bypass or interfere with our verification processes
• Use our services for discriminatory purposes
• Resell or redistribute our services without authorization
• Scrape, reverse engineer, or extract data from our platform

API Usage and Rate Limits

When using our API:

• You must implement proper error handling and retry logic
• Rate limits apply based on your subscription plan
• API keys must be kept secure and not exposed publicly
• HMAC signatures must be correctly implemented for authentication
• Webhook endpoints must respond within 30 seconds

Pricing and Payment

Our services are billed on a usage-based model with a minimum monthly fee. Pricing depends on whether document processing is involved:

• Age Estimation (selfie only) — billed at the Age Verification rate
• ID Age Verification (document + selfie) — billed at the Document Verification rate
• KYC Verification (document + selfie) — billed at the Document Verification rate

Billing terms:

• A verification is billed only when it reaches a final status (approved or rejected); abandoned or timed-out sessions are never charged
• A minimum monthly fee applies — if your usage for the month is below the minimum, the difference is charged as an adjustment
• Billing is calculated for each calendar month (1st through the last day) and invoiced after the month ends
• The minimum monthly fee applies in full from the first calendar month in which billing starts, including partial months
• Current pricing and your minimum fee are displayed in the Billing section of your dashboard
• All fees are non-refundable unless otherwise stated
• Prices are subject to change with 30 days notice
• Failed payments may result in service suspension

You authorize us to charge your payment method for all fees incurred.

Service Level Agreement (SLA)

We strive to maintain:

• 99.9% uptime for our API services (excluding scheduled maintenance)
• Average response time under 500ms for API requests
• Verification processing within 2-5 minutes

SLA credits may be available for enterprise customers experiencing extended downtime.

Data Processing and Privacy

By using our services, you acknowledge that:

• You have obtained necessary consents from end users for data processing
• You will comply with all applicable data protection laws
• ProofAge acts as a data processor on your behalf
• You are responsible for your users' data rights requests

Intellectual Property

All content, features, and functionality of ProofAge services are owned by us and protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use our services in accordance with these terms.

Warranty Disclaimer

ProofAge services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the maximum extent permitted by law:

• ProofAge shall not be liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the past 12 months
• We are not liable for verification decisions you make based on our results
• You are responsible for implementing additional security measures as needed

Indemnification

You agree to indemnify and hold ProofAge harmless from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your account immediately, without prior notice:

• For violation of these Terms of Service
• For fraudulent or illegal activity
• For non-payment of fees
• At our discretion for business reasons

You may cancel your account at any time through the dashboard.

Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the new terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration.
